What is the I-907 form?

The I-907 application form is entitled Request for Premium Processing Service and can be used as an optional expedited process when applying for a visa. With this, the USCIS guarantees processing within 15 calendar days of receipt of the application. However, the Premium Processing procedure does not mean that the USCIS will generally make a decision on the application within 15 days. The USCIS has the possibility at any time within this period to make inquiries about the application (Request for Evidence, RFE).

Premium processing therefore means that USCIS has 15 calendar days to decide on the application or to ask further questions.

Unfortunately, not all processes can be accelerated via Premium Processing. For the common work visas (Petition for a Nonimmigrant Worker) applied for through U.S. Citizenship and Immigration Services (USCIS) in the United States, however, the premium processing procedure may be chosen.

Premium Processing is currently offered for the following nonimmigrant visas:

  • E-1
  • E-2
  • E-3
  • H-1B
  • H-2B
  • H-3
  • L (L-1 Blanket included)
  • O
  • P
  • Q
  • R
  • TN

Premium Processing is currently offered for the following immigrant visas:

  • EB-1
  • EB-2
  • EB-3

Attention: Applications for work visas that are regularly submitted to USCIS in the United States (= regular processing) are currently expected to take an average of about 4 to 8 months to process, although processing times can vary greatly depending on the USCIS service center responsible. Given the measures taken to contain the coronavirus pandemic, further delays in processing times are to be expected. For urgent postings, it is without question advisable to use the optional Premium Processing procedure. However, applicants are strongly advised to check in advance whether USCIS allows Premium Processing for the visa category applied for.

How to apply for Premium Processing?

To reduce USCIS processing time, applicants must do the following:

  1. Submit I-907 along with I-129 or I-140 form.
  2. Pay additional fee or Premium Processing Fee of currently $2,500 for all applications except H-2B or R-1 applications, which are $1,500.

Tip: The accelerated application procedure with Premium Processing can also be added afterwards, i.e. for (still) ongoing procedures, without complications. In the case of ongoing I-129 applications, for example Petitioner for the Premium Processing Upgrade, mail Form I-907 along with an application check for $2,500 (or $1,500 for H-2B and R-1) to the appropriate USCIS Service Center where the application is currently being processed. Subsequently, the USCIS will acknowledge receipt by e-mail.
