What is the I-907 form?

The I-907 application form is entitled Request for Premium Processing Service and can be used as an optional expedited procedure when applying for a visa. With this, the USCIS guarantees processing within 15, 30 or 45 business days of receipt of the application. However, the Premium Processing procedure does not mean that the USCIS will generally make a decision on the application within these specified days. The USCIS has the possibility at any time within this period to make inquiries about the application (Request for Evidence, RFE).

For which applications can Premium Processing be used?

Currently, only selected USCIS procedures can be expedited via Premium Processing.

For the common US work visas that are applied for via the U.S. Citizenship and Immigration Services (USCIS) in the United States via I-129 (Petition for a Nonimmigrant Worker), however, the Premium Processing procedure can be selected. In addition, the express procedure can also be used for certain applications for extension of status or change of status and when applying for a general work permit (EAD).

Premium Processing is currently offered for the following nonimmigrant visas:

  • E-1
  • E-2
  • E-3
  • F-1
  • F-2
  • H-1B
  • H-2B
  • H-3
  • J-1
  • J-2
  • M-1
  • M-2
  • L (including L-1 Blanket)
  • O
  • P
  • Q
  • R-1
  • TN

Premium Processing is currently offered for the following immigrant visas:

  • EB-1
  • EB-2
  • EB-3

For urgent postings, the use of the optional Premium Processing procedure is recommended without question. The I-907 form is then submitted together with the I-129 application form, for example, which is the standard application form for work visas applied for via the USCIS in the United States. However, applicants should check in advance whether the USCIS allows the Premium Processing procedure for the visa category applied for.

How to apply for Premium Processing?

To reduce USCIS processing time, applicants must do the following:

  1. Submit I-907 along with the appropriate application form (I-129, I-140, I-539 oe I-765)
  2. Pay the Premium Processing Fee of currently $2,805 for all applications except H-2B or R-1 applications, which are $1,685
The accelerated application process with Premium Processing can also be easily added afterwards, i.e. for (still) ongoing procedures. For ongoing I-129 applications, for example, petitioners must submit the I-907 form for the Premium Processing upgrade together with the application check by mail to the relevant USCIS Service Center where the application is currently being processed. USCIS will then confirm receipt by e-mail.

What are the processing times?

USCIS expedited processing times vary depending on the application type.

  1. 15 business days
    for I-129 applications (Petition for a Nonimmigrant Worker)
  2. 30 business days
    for adjustments of status (I-539 Application to Extend / Change Nonimmigrant Status) and EAD applications (I-765 Application for Employment Authorization)
  3. 45 business days
    for I-140 applications (Immigrant Petition for Alien Workers)
