The I-797 form is a notification document issued by the United States Citizenship and Immigration Services (USCIS). It is used to acknowledge receipt, approval, denial, or other actions regarding a variety of applications in the immigration process.

What is the I-797?

The I-797 (Notice of Action) is a notice issued by U.S. Citizenship and Immigration Services (USCIS) in the context of certain visa applications (e.g. H visa, L visa, O visa).

There will be different types of I-797 issued. For example, the receipt of an application is acknowledged by means of the I-797C letter (Receipt Notice). If the USCIS has any questions about a pending application, applicants will receive the I-797E (Request for Further Evidence) letter.

Application to the USCIS: Petition

Certain US visa applications can only be filed by the prospective employer, e.g., the applicant's US company or agent in the US (Petitioner), for the particular employee (Beneficiary).

If, for example, an L-1 visa is to be applied for the employee, the future employer:inside in the USA must file a petition with the responsible service center of the United States Citizenship and Immigration Services (USCIS). In addition to the application forms, this petition includes extensive documentation on the US company or group of companies, the position to be filled in the US, and the foreign employee's current job and qualifications.

Approval Notice

After reviewing the petition and the corresponding application forms, the USCIS informs the U.S. employer in writing about the approval or rejection of the petition. This notification is made by means of the notification letter I-797. If the petition is approved, the US company receives what is known as an I-797 Approval Notice by mail. The foreign employee will need this document in the subsequent consular process for his or her U.S. visa application.

The I-797 letter always contains information about the Petitioner, Beneficiary, the category requested, and a case number under which the request is being processed. In the case of approval letters, the document specifically shows the term (i.e., approval period) of the work permit, for example.
