ePassport - The most important information about the biometric passport

If you want to travel to the USA, you absolutely need a valid passport. Reason enough to take a closer look at the passport regulations.

What is a biometric passport?

The biometric passport or electronic passport, ePassport for short, contains a chip on which the passport holder's biometric data is stored. The ePassport was introduced in Germany at the beginning of November 2005. All German passports issued since November 1, 2005 are therefore automatically ePassports. The following data of the holder is stored in it:

  • Passport number
  • Issuing state
  • Document type
  • Validity date
  • Passport photo
  • Nationality
  • First name
  • Surname
  • Gender
  • Date of birth
  • Fingerprints

How can I tell if I have an ePassport?

The easiest way to recognize an ePassport is by the following symbol on the cover:

New passport 2017

Since March 2017, a new passport has been issued with more modern materials and improved security features. This means that the German passport remains one of the most (forgery) secure in the world and allows visa-free entry to over 170 countries. The new features are as follows:

  • The format is smaller than the previous one and the hardcover has been replaced by a flexible passport cover
  • The passport card (photo side) is now made of hard plastic (polycarbonate), like the German ID card. Embedded in it is a security thread on which the document number and the holder's name are stored
  • The inner pages have been replaced with a new security paper that contains a halftone watermark, among other things. As a color highlight, a colorful Brandenburg Gate shines on the center pages.

Important to know:
Your "old" passport remains valid until the expiration date and can be used for travel without restrictions. You will only need to apply for a new passport once it has expired.

Applying for a passport - passport validity and passport costs

In Germany, ePassports are issued by the Bundesdruckerei. Applications for biometric passports are made at the relevant citizens' office.

The costs for a passport currently amount to:

  • 60.00 Euro for adults
  • 37.50 euros for persons under 24 years of age

As the fingerprints are taken by the authorities when applying for a passport, it is essential to appear in person. Among other things, the inclusion of fingerprints in the passport is intended to provide more security at border controls in that the passport holder can still be clearly identified despite any external changes.

Applications for children will only be accepted if the birth certificate is available as well as proof of custody and, if applicable, a declaration of consent from the parent who is not present.

Express passport, temporary passport and children's passport

In addition to the regular application, those who are in a particular hurry can apply for an express passport or a temporary passport. Please note that both a temporary passport and a children's passport can only be used for international travel to a limited extent.

The application procedure is the same in all cases. This means that, as described above, you must go to the local citizens' office. The passports only differ in terms of processing time and validity:

Applying for a passport in the USA

If you are a German citizen who has been living in the USA for some time and would like to apply for a new passport, there are two options. Which passport authority is responsible for issuing the new passport depends on where you are registered.

  1. If you have been living in the United States for a longer period of time but are still officially registered in Germany, you can apply for a new passport from the responsible office (e.g. Bürgeramt) if you are a German citizen staying in Germany.
  2. If you are already deregistered - which is often the case for people who have been in the USA for a long time - you can only apply for a passport in the district of your current place of residence in the USA where you are staying permanently. The German diplomatic missions abroad, i.e. embassies and consulates, are responsible for German citizens in the USA. When applying for a new passport, you will usually have to submit a certificate of deregistration from your last German municipality of residence.
    You can find out which of the nine German diplomatic missions in the USA is responsible for you on the website of the Federal Foreign Office.

What if a passport does not meet the ESTA requirements?

We recommend that all travelers inform themselves in good time before any planned stay in the USA about the current entry requirements, including the current passport regulations, in order to prevent problems when entering the country.

The passport requirements for visa-free entry to the USA with ESTA, for example, were tightened in April 2016. Accordingly, all persons traveling to the USA without a visa must be in possession of aePassportsbe. In addition to a valid ePassport, a valid ESTA authorization is still mandatory.

Entry to the USA with ESTA is therefore not possible with either a temporary passport or a child's passport. If you thereforedo not have a regular biometric passport, you cannot use the visa-free entry under the Visa Waiver Program. Of course, you still have the option of traveling to the USA. However, you would have to alternatively request a B-1/B-2 visa.

You always need a visa for the USA if you are in possession of one of the following identity documents:

  • non-electronic passport
  • Children's passport
  • temporary passport
  • Child ID card
  • Travel document
  • Travel document for foreigners

Do accompanying children of main applicants need a biometric passport?

A passport is mandatory for entry into the USA, this also applies to infants and children. Only people who have a biometric passport can participate in the visa waiver program. If your child only has a child passport, a visa for the USA would have to be applied for automatically, which is relatively time-consuming. With this in mind, it is generally advisable to apply for a machine-readable, biometric passport for children, even if the issuing authorities often suggest a children's passport.

If your child has a child passport, this is not valid for visa-free entry to the USA. Children's ID cards are also not permitted for visa-free entry, so if your child only has a children's passport, they will need a US visa to legally enter the United States.

How long does the passport have to be valid to travel to the USA?

In general, the passport must be valid for six months after the planned departure.
For example, if you would like to enter the USA on July 1, 2018 with a visa for six months, the general rule is that your passport must be valid until July 1, 2019.

Special rule for "Six-Month Club" members

There is a special regulation for persons who belong to countries of the so-called "Six-Month Clubs" belong. The passport of a person with nationality of a country that is a member of the "Six-Month Club" only needs to be valid until the end of the planned departure. In the above example, if you enter the country on July 1, 2018, your passport would only have to be valid for 6 months until January 1, 2019.

Fortunately, Germany, Austria and Switzerland are on the list of members and are therefore among the countries of the "Six-Month Clubs".

Valid US visa in expired passport

Your US visa is generally valid until the expiration date - even after your passport has expired. This means that the visa remains valid even if your passport expires. Accordingly, when entering the USA, you have the option of presenting your US visa in your old (expired) passport together with your new passport at the border. These are the requirements:

  • It is important that your US visa was not damaged when the expired passport was invalidated by the Citizens' Office. Only then is the visa valid until the expiration date.
  • You should also make sure that your visa has not been removed from your old passport and therefore also loses its validity.
  • Another requirement is that the nationality in both passports must be identical. In the event that you have adopted a new nationality or your biometric data has changed, you must apply for a new US visa.
  • In this context, it is also important that your US visa still corresponds to the main purpose of your trip. For example, if you are in possession of a E-visas you can enter the USA with this visa and work for a company within a certain period of time.

If your name has changed (e.g. due to marriage or divorce), you do not necessarily need a new US visa. If you change your name, you can normally travel with your old, still valid US visa, but you should carry the relevant proof (e.g. marriage certificate) and both passports with you when you enter the country.

Loss of passport

The passport is the most important document for a stay abroad, e.g. in the United States. It is therefore advisable to make a copy of your passport and US visa before you travel to ensure that you can react as quickly as possible in the event of loss.

If you have lost your passport, including your US visa, or if it has been stolen, you should take the following steps immediately:

Police report and new passport application

If you lose your passport, contact the local police so that the circumstances of the loss can be recorded in writing in a police report. A copy of the police report must usually be submitted when you apply for a new passport.

Reporting the loss of the visa to the US authorities

Contact the relevant US consulate immediately and report the loss of your visa. German nationals should send an e-mail to the relevant US consulate that issued the visa:

Your notification to the US Consulate should include the following information:

  1. Your full name
  2. Date of birth, place of birth
  3. Address in the USA
  4. Cause of loss (theft or loss)
  5. Copy of your passport or visa

Do I have to leave the USA directly?

Losing your passport in the USA does not mean that you have to leave the country immediately. Rather, the decisive factor for legal residence status is a validI-94 Form.

In particular, if you are unable to identify yourself if you lose your passport, you should now always carry the I-94 document with you (as proof that you are legally authorized to stay in the USA). The I-94 form indicates how long you are physically allowed to stay in the USA and under what status. Please note, however, that when you leave the USA, you will need either a new visa or a new ESTA authorization to re-enter the country.

Where do I apply for a new passport in the USA?

If your passport is stolen or lost in the USA, you will need a new travel document to leave the country (usually for the airline). For your return journey, the German Embassy or the respective consular mission in the USA for example a"Travel document as a passport replacement" (RAP)issue. Passport found after loss report: Can I continue to use it?

If you report the loss of your passport to the US embassy and then find it again, the process can no longer be reversed and the passport or US visa can no longer be used for entry into the USA.

US visas contained in lost passports must be reapplied for.To apply for a new US visa, you must attend a new interview appointment at the US consulate in your home country or place of residence after your passport has been reissued. In addition to the generally required application documents, please also bring the police report from the USA with you.
